How New York sets the benefit

For injuries from July 1, 2026, the Board set the minimum at one fifth of the state average weekly wage, $384.45, or the worker's actual wage if that is lower. Before July 1, 2026 the minimum was a fixed dollar amount.

The maximum is two thirds of the state average weekly wage, so a worker earning about $1,922 a week or more is capped at $1,281.50.

These figures are for temporary total disability only. Partial, permanent and death benefits use different rules and caps, and eligibility, the average weekly wage calculation and the injury date all have to be confirmed with the claims administrator or the New York State Workers' Compensation Board.
